POLICE: Weekly Police Blotter

CRIMINAL MISCHIEF:
Domenico Logalbo, 73, of New Castle, is charged with Criminal Mischief after police witnessed Logalbo through surveillance cameras using spray paint to paint property lines on the property of the Borough of Ellwood City on August 19th. According to a criminal complaint, Logalbo has complained multiple times that the borough property is his and that lawyers had advised him that it is not his property. Logalbo was found to be spray painting lines, arrows, and lettering on the borough property and officers confronted Logalbo and advised he will be charged for defacing public property. Logalbo said to speak to his lawyer and left the scene at approximately 4:35 p.m. the complaint relates.

CHILD PORNOGRAPHY:
Thomas Hyatt Baney, 20, of Wampum, is charged with Child Pornography, Indecent Exposure, and Corruption of Minors among other charges after an incident reported earlier in September 2023. According to a criminal complaint, PA State Police assigned to the Computer Crime Task Force received two CyberTip reports, the first on July 14, 2023 and a second on September 4, 2023, and open a case based on eight combined video and photo files containing suspected Child Pornography. After collecting identifying IP information for a location, members of the BCI, Computer Crime Unit, and PA State Police served a search warrant on Penn Avenue, New Brighton on September 13th and seized multiple items from the residence. Police were informed Hyatt Banet resided at the residence from May to September before going to Pace University in New York. According to the complaint, cropped images of the adult and child’s faces were shown to the residence on Penn Avenue, both the child and Hyatt Baney were identified. An interview with the child’s mother related she spent the night at Hyatt Baney’s Wampum residence before her son’s 3rd birthday in late June/early July and she would have never suspected him to be inappropriate with the child the complaint relates. Through investigation it has been determined that the sexual assaults and production of child pornography occurred at the residence in Wampum and based on the facts and circumstances of the case an arrest warrant has been issued for Hyatt Baney.

DISORDERLY CONDUCT/HARRASSMENT:
Alexander Kennard, 18, of Ellwood City is charged with Disorderly Conduct, Terroristic Threats, Harassment, and Criminal Mischief after an incident on September 4th. According to a criminal complaint, police were approached by a man who advised his daughter was beat up and her car was vandalized in Ewing Park. Police obtained a verbal statement from the victim who related she met a male in Ewing Park to hang out but was then approached by Alexander Kennard and his brother Skyler along with a group of others and the brothers threatened to jump the victim. The female victim related she pepper sprayed Skylar Kennard to get away and at that time Alexander approached and pulled a pistol from his waist band, holding it and threatening her while she retreated to her vehicle. According to the complaint, once in the vehicle both Alexander and Skyler began hitting the vehicle, causing a total of $3,000 in damages. Ellwood City Police were able to review surveillance footage from the area during the times of the reported incident and based on the statements from the victim, police were able to collaborate the exact story as the victim described. Based on the written statements, video footage, and messages, police charged Alexander Kennard with Disorderly Conduct, Terroristic Threats, Harassment, and Criminal Mischief. Skyler Kennard, 20, is charged with with Disorderly Conduct, Harassment, and Criminal Mischief.

USE/POSSESSION:
James Cody, 56, of Ellwood City, is charged with Trespassing and Use/Possession of Drug Paraphernalia after an incident on September 4th. According to a criminal complaint, and at approximately 6:16 p.m, police were detailed to the Uni-Center in an attempt to locate a suspect in a previous incident in Wayne Township, but when police entered the common area of the basement officers observed three individuals in an apartment of a residence that is not to have anyone on the property. Police identified the individuals, the last being identified as Cody who initially gave officers false identifying information. Cody was placed under arrest for trespassing and searched him incident of arrest. According to the complaint, police located three clear, hard, plastic containers containing clear crystal like substance folded inside the waist band on Cody. A container with white powder residue, a blue lighter, white straw, and black digital scale were also located. Cody was transported back to ECPD where he was later found to have an active bench warrant out of Cumberland County and is wanted on a State Parole Violation.

ACCESS DEVICE FRAUD:
Gerald Robb, 62, of Carnegie, PA, is charged with Access Device Fraud after police investigation found he committed the offense of access device fraud when he made three, separate unauthorized transfers from an area victim’s bank accounts totaling $90,000.00. Furthermore, it was found that Robb committed unauthorized credit card charges in the amount of $82,108.34 using the same victim’s bank credit card. According to a criminal complaint, Robb was a caretaker for a husband and wife beginning in 2019, and after the husband’s passing, Robb’s caretaker work schedule changed from seven days per week to weekends between May 2022 and December 2022, working weekends. In a review of the victim’s credit card statements, her niece observed suspicious transactions made by Robb who did not have authorization to use the credit card, and through the course of the investigation discovered his Amazon account was linked to the victim’s credit card. Robb was terminated as the caretaker on or about January 11, 2023. The unauthorized uses took place between June 2019 and December 2022.

DUI:
Ian Frey, 36, of Ellwood City, is charged with DUI after a one vehicle motorcycle accident on August 16th. According to a criminal complaint, and at approximately 1:07 a.m., police were dispatched to an area on Wurtemburg Road, Wayne Township for an accident. Police made contact with Frey who said he was traveling home when he lost control and slid on the roadway. According to the complaint, Frey appeared highly intoxicated and related to police he had several drinks at two local bars. Police administered a field sobriety test but stopped for his safety. Frey consented to a breath test for which he failed and was placed under arrest for DUI and transported to a nearby hospital for a blood draw.

DUI:
Timothy Myers, 41, of Ellwood City, is charged with DUI after a one vehicle crash on May 25th. According to a criminal complaint, and at approximately 3:58 a.m., police were dispatched to an area on Route 488 in Perry Township for an accident. Upon arrival, police found a Ford Escape down an embankment and later located Myers along side the roadway who was found to be intoxicated. Police conducted a field sobriety test for which Myers failed and he was placed under arrest for DUI and transported to a nearby hospital for a blood draw.
